RE: The tariff classification of a steam cleaner and replacement cloth pads from China

Dear Mr. Marin:

In your letter dated June 8, 2009 you requested a tariff classification ruling on behalf of Thane Direct USA. Representative samples were submitted and will be returned.

The product you plan to import is described as the H2O Mop, an electrothermic appliance used in the home to steam clean floors. The identical item/cleaner is made by two different manufacturers each having separate style numbers, SKU #808.092 or OEM TV-001. This product includes the steam cleaner appliance, a measuring cup, a user guide, a carpet glider attachment and two microfiber cloth pads.

In addition to the steam cleaner, replacement cloth pads will be imported separately as well. These pads are attached to the mop head that is used to clean the floor. SKU# 220-C052 is a cloth pad made from 80 percent polyester and 20 percent polymide knit pile fabric. The edge of the pad is finished and contains a drawstring closure.

SKU# 220-C003 is a disposable cloth pad. You state that the pad is made from 66.5 percent polyester and 33.5 percent viscose non-woven fabric. The pad has an elasticized edge.

The applicable subheading for the steam cleaner will be 8516.79.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other electrothermic appliances. The rate of duty will be 2.7 percent ad valorem.

The applicable subheading for the cloth pads when imported separately will be 6307.10.2030, HTSUS, which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: other… other. The duty rate will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
